Declaration of capacity & intent

Please answer the following four questions before completing your will instructions. This is a legal document — please take your time.

Testamentary capacity: To make a valid will you must understand what a will is, the extent of your estate, and who might reasonably expect to benefit. Everything you tell us is treated in strict confidence.

Do you understand you're completing instructions for your legal will?

A will is a legal document that sets out how your estate will be distributed on your death.

Do you have any medical condition that may affect your ability to make a valid will?

Examples: dementia, Alzheimer's, recent stroke, or a serious mental health condition affecting memory or judgment.

Are you completing this form entirely of your own free will?

A will is only valid if you make it freely and of your own choice. No-one should pressure or manipulate you.

Are the decisions you're making entirely your own?
